Police Log: Feb. 2, 2010 — Felony arrest

PLATTSBURGH — A Plattsburgh man is accused of writing dozens of letters while incarcerated to someone he was legally prohibited from contacting.

A Clinton County Sheriff's Department deputy arrested Joseph L. Weare, 30, on Thursday and charged him with aggravated criminal contempt, according to a Sheriff's Department news release.

The charge alleges that Weare, while incarcerated at the Clinton County Jail, wrote about 54 letters through a third party to Felicia Cook, who had an order of protection against him.

Weare, who has been held at the jail since August, was arraigned in Town of Plattsburgh Court and sent back to County Jail with bail set at $1,500 cash or $3,000 bond.

Felicia, who police allege reciprocated Weare's request for correspondence for about three months, was charged with fourth-degree criminal facilitation.

She was issued an appearance tickets and is scheduled to appear in Town of Plattsburgh Court on Feb. 11.

Weare was originally arrested Aug. 23, following a report of a burglary at 59 Johnson Ave. in Plattsburgh.

At that time, Plattsburgh City Police allegedly found Weare inside the home, which was occupied by a person with a court order of protection from him.

According to City Police, he admitted talking with the person and violating the court order. Weare was subsequently charged with first-degree criminal contempt and second-degree criminal trespass.
