MALONE — Dozens of North Country nonprofit agencies have automatically lost their tax-free status with the Internal Revenue Service.
But organizations can re-apply for reinstatement and pay a fee to restore their status, the IRS said in a news release.
REQUIRED FILING
Nonprofit status is lost when a tax-exempt organization fails to file an annual information notice with the IRS for three consecutive years; in this case, it was for 2007, 2008 and 2009.
"During the past several years, the IRS has gone the extra mile to help make tax-exempt groups aware of their legal-filing requirement and allow them additional time to file," IRS Commissioner Doug Schulman said in a statement.
Some small groups still may not know the new requirements, he said, "and we are taking additional steps for these groups to maintain their tax-exempt status without jeopardizing or harming their donors."
DONATIONS
Donors who made tax-deductible contributions should not be impacted because donations made prior to the list being published remain tax deductible.
But those organizations that are not reinstated are no longer eligible to receive tax-deductible contributions, and any income they receive could be taxed.
LOWER FEE
The IRS is offering transition relief to organizations with annual gross receipts of $50,000 or less for 2010 to help them regain their nonprofit status.
The organizations can regain their eligibility retroactive to the date of revocation by paying a lower, $100 application fee, rather than the typical $400 to $850 fee.
The release states that most tax-exempt groups file the requested paperwork and that a majority of the newly revoked agencies on the list "are no longer in existence and need to be removed from the tax-exempt list, as the 2006 law requires."
