No charges in pedestrian fatal

MALONE — Pedestrian error is being blamed for a fatal crash on Route 30 that killed a Malone man about 11 p.m. Saturday.

Timothy L. Raymond, 40, of Paradise Road was apparently walking in the northbound lane of Route 30 about six miles south of Malone when he was struck by a vehicle operated by Gary J. Landry, 56, of Malone.

Franklin County District Attorney Derek Champagne said the preliminary State Police investigation is pointing to pedestrian error as the likely cause “and that there is no criminal liability on the part of the driver.”

He said he is awaiting toxicology reports from both Landry and Raymond, as well as the autopsy findings, to make a final determination.

County Coroner Brian Langdon pronounced Raymond dead at the accident site and ordered the body removed to Canton-Potsdam Hospital for the autopsy.

State Police are continuing the investigation, along with the Bureau of Criminal Investigation Collision Reconstruction Unit.
